1. Previous

foodandfriends wishes to inform the users of its website of its policy regarding the processing and protection of the personal data of those people who voluntarily use e-mail to contact us or any other service on the website that involves the communication of their personal data.
For these purposes, personal data shall be understood as any information concerning identified or identifiable natural persons – including e-mail data and/or IP address – and user shall be understood as any identified or identifiable natural person who communicates their personal data to foodandfriends, through the use of any service on the website of the aforementioned entity.

2. Identification of the business name of the data controller

foodandfriends informs the user of its website of the existence of a personal data processing file for which it is responsible, with registered office at Antonio Marqués 15 – 07003 Palma de Mallorca, where the personal data communicated by the user is collected and stored.

3. Purposes for which the personal data are used

foodandfriends does not request data from the users who visit its website, therefore, the communication of personal data by the user through its website can only be understood to take place when they voluntarily use the e-mail service or the “contact” section to get in touch with us, given that in these cases the processing of data is inevitable and implicit in the communication system used by the user.
For these cases and those described in the following section “4”, foodandfriends informs the user that the processing of data is carried out for the following purposes:
To carry out all the formalities related to the contracting and provision of services by foodandfriends to the interested party who requests it in their own name and representation, to attend to and answer the communications received, and the maintenance of historical records of commercial relations.

4. Consent

foodandfriends informs the user of its website that this privacy policy contains all aspects related to the processing of personal data that we carry out as the party responsible for it.
Thus, when the user does not maintain commercial relations with foodandfriends, he/she must take into account and is informed that the sending of an e-mail or the communication by the user of any other personal data entails or implies the provision of his/her free, unequivocal, specific, informed and express consent for the processing of his/her personal data, for the purposes established in section “3” of this privacy policy, as well as to attend to his/her communication or send information. Otherwise, if the user does not agree, please refrain from sending e-mails or communicating your personal data to foodandfriends.
For the same purposes foodandfriends also informs that, if the user sends an email or communicates their personal data because of the position they hold in a company – whether as an administrator, manager, representative and/or any other position as a contact person in the company – it will be understood that such communication entails the provision of their unequivocal free, specific, informed and express consent for the processing of their personal data, for the purposes set out in section “3” of this privacy policy, as well as attending to their communication or sending information. Otherwise, if the user does not agree, please refrain from sending emails or communicating their personal data.

5.Request for information

When the user, either in his own name and representation or in representation or contact of a legal person, considers that the information provided in this policy is not sufficient or lacks clarity, specificity or information, we ask that before sending us an e-mail and consequently your personal data, you request the additional information you consider necessary, by sending a written communication by ordinary mail to the social address indicated in section “2” of this policy.

6. Identification of the recipients for whom foodandfriends intends to transfer or communicate data

foodandfriends only foresees the transfer or communication of data that, in accordance with article 11.2.c. of Organic Law 15/99 on the protection of personal data (hereinafter LOPD), must be carried out in order to fulfil its obligations to the Public Administrations in those cases where this is required in accordance with the Legislation in force at any given time and, where appropriate, to other bodies such as Judges, the Public Prosecutor’s Office, the Courts, the Court of Auditors or the Ombudsman.
foodandfriends informs the user that any other transfer of data to be made, will be made known to the user when so provided for in the LOPD, informing him/her expressly, precisely and unequivocally of the recipients of the information, the purpose for which the data will be used, and the nature of the data transferred, or when the LOPD so provides, the unequivocal, specific and informed consent of the user will be requested beforehand.

7. Other recipients of information

Notwithstanding the provisions of the previous section, foodandfriends informs the user that any processing of personal data is subject to the legislation in force in Spain on data protection, established by the LOPD and its complementary and development regulations.
In this sense, foodandfriends is only responsible for and guarantees the confidentiality, security and treatment of the data in accordance with this policy, with respect to the personal data requested by the user through the website www.foodandfriends.es and accepts no responsibility for the treatment and subsequent use of the personal data that may be carried out by third party service providers of the information society who may access such data in the provision of their services or the exercise of their activity.
Third-party information society service providers shall be understood to be – without limitation – those natural or legal persons that provide the following services:
a) Transmission by a communication network of data provided by the recipients of the service. b) Access services to the aforementioned network. c) Data storage or hosting services. d) Supply of content or information.
Likewise, foodandfriends is not responsible for the processing of data carried out by third parties who establish hyperlinks with us, nor for those responsible to whom foodandfriends refers its visitors through hyperlinks.

8. Data quality

foodandfriends warns the user that, except for the existence of a legally constituted representation, no user may use the identity of another person and communicate their personal data, and therefore the user must at all times bear in mind that, if they use e-mail, they may only include personal data corresponding to their own identity and which are adequate, relevant, current, accurate and true. For this purpose, the user shall be solely liable for any direct and/or indirect damage caused to third parties or Food and Friends by the use of personal data of another person, or his own personal data when they are false, erroneous, not current, inadequate or irrelevant. Likewise, the user who uses the personal data of a third party shall be liable to the latter for the obligation of information established in article 5.4 of the LOPD for when the personal data have not been collected from the interested party, and/or for the consequences of not having informed him/her.

9. Data of minors or incapable persons

If the user is a minor or incapable, foodandfriends warns of the need to have the consent of their parents, guardians or legal representatives for the communication of their personal data, so please refrain from using the email service if you do not have the consent of parents, guardians or legal representatives, not being otherwise responsible for the actions of the minor or incapable.

10. Updating of data

The user is the only source of information about their personal data, so foodandfriends requests that, in order to keep their data updated and up to date at all times in accordance with the principles of the LOPD, they communicate to the address indicated for the exercise of the rights of access, rectification, cancellation and opposition, any variation of the same, as well as the cessation of their activity in the entity they represent, where appropriate, in order to proceed to the cancellation and/or historical treatment of the same.

11. Exercise of the rights of objection, access, rectification and deletion of data

foodandfriends informs users of the possibility of exercising their rights of access, rectification, cancellation and opposition by means of a written request accompanied by their National Identity Document addressed to the following address: Acaia, 3 B3 3B – 07610 Palma de Mallorca, or the address that replaces it and is communicated in the General Data Protection Register.
